The term ‘transport operator‘ refers to a company or individual who is promoting their transport services through the price comparison system of www.myshuttles.com. The term ‘transport product‘ refers to any offer made by a transport operator through the www.myshuttles system. The term ‘price comparison screen(s)’ refers to Step 2 of the booking system on www.myshuttles.com.

How My Shuttles works
www.myshuttles.com instantly accepts online bookings making it possible for you, the user, to travel from one chosen location to another. The system has been developed for easier access to private and shared transportation for the user. We are providing access to a variety of multi-lingual communities as well as access to a variety of different currencies.
Step 1: When making a booking the user will enter the points of departure and arrival. The user will enter the date of departure as well as preferred time of travel. If a journey has already been entered into the system by the supplier the user will continue to book and pay for their journey however if a journey is not available the user will have the option to register their details and the requested journey will be sent to any transport operator working in the relevant region. Quotes from transport operators will be sent to the user within a certain amount of time. More than one price quote can be sent to the user. Many suppliers can bid for the user’s journey.
Step 2. Once the user has selected the points of departure and arrival the transport product will be listed (price comparison screen) where the user can then confirm the journey selection by clicking on the green cross. A supplier may have a higher or lower price fare therefore the user can select the option that gives the desired balance between price and service.

Step 5. The user is able to print the booking (booking voucher) which he must present when he travels on his journey.

Customer Contract
www.myshuttles.com is a transport price comparison website and booking agent. All journey and travel product information on the website is provided, managed and updated by each individual transport operator. Themba Enterprises Limited (trading as www.myshuttles.com) is a contracted and authorised agent for all suppliers listed in the price comparison section of the booking process (Step 2). It is the contractual responsibility for each individual transport operator to check and maintain accurate information and pricing. No liability for misleading information, non-complete information, typography errors or other mistakes will be accepted by Themba Enterprises Limited (trading as www.myshuttles.com). Before any transport operator is permitted to submit their products to the www.myshuttles.com system they must provide copies of their business registration document, transport operating licence and public liability insurance relevant to their operating areas. This is checked by Themba Enterprises Limited and by Moneybookers before products are made live and access to the Moneybookers controlled payment system and fund transfer system is granted.

When a reservation is made through www.myshuttles.com or through booking engines and product feeds provided to affiliate websites the user is entering into a direct and binding contract with the individual transport company selected from the comparison screens. The operation of your booked journey will be governed by the terms and conditions of each individual transport operator which is displayed and accepted during the booking process.

Supplier Terms and Conditions explanation
During the reservation process the individual making the reservation will be asked to agree to the Terms and Conditions of Themba Enterprises Limited (trading as www.myshuttles.com) and to the Terms and Conditions of the chosen transport operator. It is essential that both these Terms and Conditions are read and understood in order that the basis for delivery of the transport product from the chosen transport operator is understood.

Cancellations and Amendments
Once a booking has been made with a transport operator it is governed by the terms and conditions of the operator. At the time of booking confirmation the cancellation period and contact details of the transport operator will be displayed on your travel voucher. Should you need to cancel or amend a booking then this should be done directly with the transport operator using the contact details supplied.

Special Requests
Special requests do not form part of the contractual agreement between the travelling party and the transport operator. All possible effort will be made by the transport operator to accommodate special requests but they are not guaranteed.

Payment
Themba Enterprises Limited (trading as www.myshuttles.com) works in partnership with Moneybookers of Welken House, 10-11 Charterhouse Square, London EC1M 6EH, UK. Moneybookers are an international payment processing and e-wallet provider regulated by the British Financial Services Authority. Use of www.myshuttles.com is free of charge. Payments are made directly to the transport operator and no charge is made by Themba Enterprises Limited (trading as www.myshuttles.com) to the user.

User reviews
Themba Enterprises Limited (trading as www.myshuttles.com) aim to encourage all transport operators to operate the best possible services by providing a user feedback score to users using www.myshuttles.com to compare and reserve travel products. Once a transport product is carried out by a transport operator the user will receive a short feedback questionnaire. Themba Enterprises Limited (trading as www.myshuttles.com) encourages all users to complete this short questionnaire honestly and fairly in order to empower future users in their transport product selection. The resulting anonymous information will remain the property of Themba Enterprises Limited and will be used to provide a points rating of each transport operator. This will be subsequently displayed on the price comparison screen.

Languages
www.myshuttles.com is provided for use in multiple languages. Every effort is made to ensure accuracy of these translations in each language. In the case of any dispute the English version of the Terms and Conditions will be used.

Liability
Themba Enterprises Limited (trading as www.myshuttles.com) or any marketing partners or affiliated companies will not be liable for any direct or indirect loss including but not limited to loss of revenue, loss of contract, loss of earnings, loss of reputation or damage to goodwill and loss of claim incurred or paid by a user resulting from inaccuracy of travel information provided by any transport company operating in any region. This information includes but is not limited to location, availability, prices, timetables and vehicle details.

Copywrite and non commercial use
All software systems, information, written text, images and and any part of www.myshuttles.com or wwwihamba.com and all intellectual property rights (including copyrights) are and will remain the property of Themba Enterprises Limited (trading as www.myshuttles.com).

Links and third party websites
Within the www.myshuttles.com website and booking software pages there may be links to external websites and companies. Themba Enterprises (trading as www.myshuttles.com) accepts no liability for the content, security, business principles or operating standards of any of these websites or companies.

Security and Privacy Policy
Themba Enterprises Limited trading as www.myshuttles.com is operated with strict privacy and non disclosure policies. Personal details are kept private and never shared with third party companies or marketing agencies under any circumstances. When a booking is made with a chosen supplier contact details are provided to the supplier in order to achieve efficient operation of the reservation and to be used for emergency contact in the case of problems or delays. Each supplier is contractually obliged to respect the Themba Enterprise Limited privacy policy in order to make all personal details confidential.

Disclaimers
By agreeing to this e-contract the user is confirming that they are the individual travelling under the booking being made or that the user is responsible for the person(s) travelling under the relevant reservation. By making a reservation through www.myshuttles.com or any affiliates using the booking network the user agrees that their contract is direct with the selected transport operator and subject to their terms and conditions that are available for reading during the booking process and before payment is made. Themba Enterprises Limited will not be liable for any damages or costs of dispute arising from inaccuracy of information and images provided by transport operators. The user agrees that personal information including name, contact number and email address will be passed directly to the transport operator once a reservation is confirmed in order that the transport product may be delivered successfully. All transport operators are contractually obliged to respect privacy rules and guarantee the safety, integrity and security of personal information.

Themba Enterprises Limited or it’s directors, employees, shareholders, partners, affiliates or representatives shall not be held liable for any direct, indirect or consequential loss resulting from misuse or abuse of our www.myshuttles.com systems.

Themba Enterprises Limited will endeavour to do everything in its power to maintain services and as close to 100% uptime as possible. In cases where functionality or availability of systems and software are affected by factors out of the control of Themba Enterprises no liability for any direct, indirect or consequential loss will be accepted from any party.

Jurisdiction
Themba Enterprises Limited is a company registered in Gibraltar and as such all disputes will be settled in accordance to Gibraltar Law.
